Terms of Service

These Terms of Service ("Terms"), together with our Privacy Policy, form a binding agreement between you and Pivot ("Pivot", "we", "us"). By installing the Pivot app on your Shopify store, using the Pivot iPhone application, joining our early-access list, or otherwise using our services, you accept these Terms.
1. The service
Pivot lets Shopify merchants create interactive 3D views of their products. The service is made of: (a) an embedded Shopify application, (b) an iPhone application used to capture products, (c) a cloud processing pipeline that turns captures into 3D assets, and (d) a storefront viewer block that displays the result on your product pages. Captures are processed automatically; processing times are indicative and not guaranteed.
2. Eligibility and accounts
The service is designed for Shopify store owners and their staff. You are responsible for the security of your Shopify account, for the devices you pair with your store, and for all activity under your account. You can revoke a paired device at any time by uninstalling the app or contacting us. Notify us immediately of any unauthorized use.
3. Early access
During the early-access period, features, quotas and pricing may change, and access may be granted, limited or paused at our discretion. Early-access benefits (such as free scans or founding-member discounts) are communicated at sign-up, have no cash value and may be modified before general availability.
4. Scans, plans and billing
A "scan" is one product capture submitted for 3D reconstruction. Relaunching a reconstruction of an existing capture also uses one scan. Paid plans include a monthly scan allowance; unused scans do not roll over. Views of published 3D content on your storefront are not metered. When billing launches, subscriptions will be charged through Shopify's billing system; prices are shown before applicable taxes. We never offer unlimited scans.
5. Your content
You retain full ownership of the media you capture and of the 3D assets generated from them. You grant us a non-exclusive, worldwide license to host, process, transform and display this content solely to operate and improve the service. We do not use your content for marketing without your written consent. You are responsible for having the rights to the products and scenes you capture.
6. Published content is public
When a 3D view is published to a product page (or shared via an embed link), the underlying 3D assets become accessible to anyone who has the link, without authentication. That is what allows your customers to see them. Unpublish or delete a scan to withdraw it.
7. Acceptable use
You agree not to: capture or upload content that is unlawful, infringing or harmful; attempt to disrupt, overload or reverse-engineer the service; resell scans or use the service to build a competing offering; or use the service outside a genuine e-commerce context. We may suspend or terminate accounts that violate these rules.
8. Third-party services
The service relies on third-party providers, including Shopify (app platform and billing), cloud storage and delivery providers, and a specialized 3D reconstruction provider that processes your capture media on our behalf. Their availability affects ours; their processing of your data is described in our Privacy Policy.
9. Data retention
Raw capture files (photos and videos) are automatically deleted from our storage shortly after processing (currently 10 days). After that, a reconstruction can no longer be relaunched from the same capture. You can always scan the product again. Generated 3D assets are kept for as long as your account is active. Uninstalling the app triggers deletion of your data as described in the Privacy Policy.
10. Availability and changes to the service
We may modify, suspend or discontinue any part of the service at any time, with advance notice when reasonably possible. We work hard to keep the service available but do not guarantee uninterrupted operation.
11. Disclaimer and liability
The service is provided "as is" and "as available". To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profits, or loss of data, and our total liability for any claim is limited to the amounts you paid us in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Termination
You can stop using the service and uninstall the app at any time. We may terminate or suspend access for breach of these Terms. Sections that by their nature should survive termination (ownership, liability, governing law) survive.
13. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-laws principles. Any dispute that cannot be resolved amicably will be submitted to the competent French courts.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or through the service. Continued use after the effective date constitutes acceptance.

The Pivot service and this website are operated by U-TREMA, a French single-member limited liability company (EURL) with a share capital of €1,000, registered with the Nanterre Trade and Companies Register under number 940 083 306 (VAT: FR53940083306), with its registered office at 1 rue Henri Pigeon, 92600 Asnières-sur-Seine, France.
